Dynamic markets and DPS: the list you can join at any time

Understand the one route into public work that does not have a closing date you can miss.

A dynamic market is a list of qualified suppliers who are eligible to be invited to bid for future work. It is the successor to what everybody still calls a DPS (a dynamic purchasing system), and it does the same job for a wider range of goods, services and works than a DPS was allowed to.

The thing that makes it worth your time

You can apply whenever you like. A contracting authority setting one up must accept applications for membership at any time, and the number of suppliers on it cannot be capped. There is no closing date to miss and no queue to be at the back of.

That is the whole difference from a framework. A framework is a closed competition with a deadline: you are on it or you are not, usually for four years. Miss the window and your next chance is when it is re-let.

How it differs from a framework, exactly

Getting on one

You apply, and the authority must admit you as soon as reasonably practicable provided you are not an excluded supplier and you meet the published conditions for membership. It is a qualification exercise, not a beauty contest: you are proving you are capable and eligible, not competing on price.

They can remove suppliers in defined circumstances, so it is not permanent, but for most firms the effort is front-loaded and then done.

The notices to watch for

  • UK13, dynamic market intention: one is about to be set up and you can apply to join.
  • UK14, dynamic market establishment: it exists. You can still apply. People assume this one means they are too late. They are not.
  • UK15, modification: its scope has changed, which may mean it now covers what you do.
  • UK16, cessation: it has closed.

One trap worth knowing about

Buyers often advertise several lots of the same dynamic market on the same day, with almost identical titles and the same closing date. They are separate opportunities, and joining for one lot does not put you in the others. On this site each lot has its own page for exactly that reason: an earlier version of the rules that spots duplicates would have merged them, and merging them would have hidden real work.

Dynamic markets currently open are marked on every list and notice page.
