The contract is awarded under the Negotiation Procedure without prior publication in line with requirements as competition was absent for technical reasons (Regulation 32 (2) (b)(ii). The Council believes that the reasons for the use of this procedure have been met due to the paucity of registered nursing homes in borough, and indeed nationally. Currently there are only 2 nursing homes registered by the Care Quality Commission in borough that is, this one and another, which is presently not in position to deliver this provision.
