The Guidance is supported by several background documents, including the Transgender International Research Literature Review 2021. In April 2025, the Supreme Court Ruling (For Women Scotland Ltd V The Scottish Ministers) ruled that, under the 2010 Equality Act, the protected characteristic of ‘sex’ means a person’s biological sex. The updated Equalities and Human Rights Commission Statutory Code of Practice for services, public functions and associations became legally binding on 5 August 2026 and provides guidance as to how the Equality Act 2010 should be applied.
